EU General Data Protection Regulation NOtice

At Nicsoft we welcome the data protections afforded by the EU's new privacy and data handling framwork. Below are our answers to the most common questions this framework addresses. If you have adddtional questions, please contact us, we're always happy to help!

Who is collecting the data?

Nicsoft LLC. A Wisconsin, USA based LLC.

What data is being collected?

We only collect information if a user reaches out to us in the form of email or phone call. In the case of a sale, if a payment transaction is initiated and completed. We do not use marketing email lists or databases of any kind.

In the case of a simple call your dialed phone number will be saved on the reached phone. In the case of email, any information you provide in the email body.

In the case of a sale, we store the following information in a secure database:

  • Email Address
  • Name (may be full, initials, etc)
  • Phone (optional)
  • Address (optional)
  • Country
  • IP Address (for registered owned of the software through our licensing server)

What is the legal basis for processing the data?

RackForms is licensed software, which means we need, for registered purchases, a record of who our valid users are. We also keep track of support requests to ensure consistent service. For example, we save all emails sent to us to ensure we know the history of a specific support request.

Will the data be shared with any third parties?

No. Data sent to us (email, phone call, etc), is never shared with outside agencies or parties. However, we do use either PayPal or Digital River for purchase payment processing. If you purchase our software, you will be agreeing to their privacy policies as well as ours.

How will the information be used?

This information is used solely to identify paid users of our software for licensing validation, and for providing customer service activities such as help tickets and answering general use questions. At no point is your data shared with any third party.

How long will the data be stored for?

Indefinitely.

What rights does the data subject have?

Any information sent to Nicsoft LLC becomes the property of said entity. For questions sent via email, we save this data in the event that person becomes a paid user. If user had specific questions about a feature, we can refer to this information for historical context.

For paid users (purchases of the software), we must keep a record of the users name and email address (at minimum), to ensure access to our software is legal.
